Fremont Pool Construction FAQs

Yes. Any pool or spa deeper than 18 inches requires a Building Permit from the City of Fremont’s Community Development Department (Planning, Building and Permit Services). Fremont regulates pools under its own Swimming Pool and Spa Code, Fremont Municipal Code Chapter 15.40, with valuation-based fees under the city’s Master Fee Schedule. Our team handles the entire permit process in Step 3 of our build program.

Lot sizes and soil conditions vary widely between these areas, which is exactly why the design phase starts with a site visit.

Flatland neighborhoods like 28 Palms and Centerville are straightforward excavations, while hillside lots in Mission San Jose and the Vineyards-Avalon area may need engineered retaining or soil reports before the city issues permits. We scope this in the design and engineering phase so there are no surprises mid-dig.

California’s SB 442 requires new and remodeled pools to include at least two of seven approved drowning-prevention safety measures, such as an enclosure fence, self-closing gates, or an approved safety cover. We build the required features into every Fremont project and document them for the city’s final inspection.
